1. Agreement to Terms

These Terms of Service govern your use of the Always Forward Health app (the "Service"), operated by Always Forward Health. By creating an account or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. Age Requirement (18+)

The Service is for users 18 years of age and older only. You must be at least 18 years old to create an account. We do not allow accounts for anyone under 18. By registering you confirm that you are 18 or older.

3. Informational Wellness, Not Medical Advice

Always Forward Health is not a medical device and does not diagnose, treat, cure, or prevent any medical condition. Guidance is informational wellness coaching only. Consult a qualified healthcare professional before starting any exercise or nutrition program.

Guidance from the app or its AI coach is not a substitute for professional medical advice, diagnosis, or treatment. Always consult a qualified healthcare provider before beginning any exercise, nutrition, or wellness program, and before making any changes based on anything you read in the app. We are not a HIPAA-covered entity.

You are responsible for checking with your doctor before starting any exercise or nutrition plan, and for deciding whether any guidance is appropriate for you. If you have a medical condition, are pregnant, or take medication, seek professional advice before using the Service.

4. Your Account and Responsibilities

• You are responsible for the accuracy of the data you log and for keeping your account credentials secure.
• Do not share your account with others or allow anyone under 18 to use it.
• You accept all risk from acting on guidance in the Service.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful, harmful, or fraudulent purpose.
• Attempt to access another user's data, reverse-engineer, or disrupt the Service.
• Enter false or misleading health information, or use the Service to harm yourself or others.
• Scrape, copy, or redistribute content from the Service.

6. Subscriptions, Trials, and Payments

The Service offers a free Starter tier and a paid Premium tier (US $7.99/month). Prices are shown in the app and may change for future renewal cycles with notice. Where a free trial is offered, the trial converts to a paid subscription at the end of the trial unless cancelled.

• Billing: Web subscriptions are billed through our payment processor (Stripe). Subscriptions purchased on Google Play, where available, are billed by Google Play and governed by Google's payment terms.
• Cancel: You can cancel anytime. Cancellation stops future renewals; you keep access until the end of the current paid period. Web subscriptions are managed at always-forward-fit.base44.app; Play subscriptions are managed in your Google Play account.
• Refunds: Refunds for web purchases are handled per to applicable law and our refund policy; contact support@always-forward-fit.com. Play refunds are handled by Google per Google Play policy.
• Elite tier: Elite 1-on-1 scheduling is currently in development ("Coming soon"). We do not charge for Elite until it is available.

We do not represent that a free trial requires no payment method where a store or processor requires one.

7. Account Deletion

You may delete your account and associated data at any time from Account Settings in the app, or by emailing support@always-forward-fit.com. See our Privacy Policy for what deletion covers and how to request it.

8. Intellectual Property

The Service, including its content, exercise library, and software, is owned by Always Forward Health and protected by applicable laws. You may not copy or redistribute it.

9. Disclaimers and Limitation of Liability

The Service is provided "as is" without warranties of any kind. We do not guarantee that guidance is safe or appropriate for you. To the fullest extent permitted by law, Always Forward Health and its affiliates are not liable for any direct, indirect, incidental, or consequential damages arising from your use of the Service, including any injury, health issue, or data loss. You use the Service at your own risk.

10. Governing Law

These Terms are governed by the laws of the jurisdiction where Always Forward Health operates, without regard to conflict-of-laws principles. Disputes will be resolved in the courts of that jurisdiction, except where consumer law gives you a right to your local courts.

11. Changes to These Terms

We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above. Continued use after changes constitutes acceptance.
